These Terms and Conditions govern the purchase and use of products, educational programs, software, subscriptions and services provided by LVLD Investments trading as Altitude Algo ("Altitude Algo", "we", "us" or "our").
By purchasing, accessing or using any Altitude Algo product or service, you agree to these Terms and Conditions.
Altitude Algo provides educational trading programs, trading technology, software tools, workshops, webinars, courses, training materials and related services.
Depending on the package purchased, the Altitude Algo program may include:
The exact inclusions applicable to a customer are those stated on the relevant sales page, order form, checkout page, invoice or written offer at the time of purchase.
All information, software, indicators, webinars, workshops, training, commentary and material supplied by Altitude Algo are provided for general information and educational purposes only.
Nothing provided by Altitude Algo constitutes personal financial advice, investment advice, legal advice, tax advice or a recommendation to acquire, dispose of or hold any financial product.
Altitude Algo does not take into account your objectives, financial situation or needs.
You are responsible for determining whether trading or investing is appropriate for your own circumstances and should obtain independent professional advice where required.
Trading financial markets involves substantial risk and may result in the loss of some or all capital used for trading.

The current full program price may be AUD $8,000, unless another price is expressly stated in the customer's invoice, sales agreement, order form or checkout page.

The price applicable to your purchase is the price agreed to at the time the transaction is completed.
Where Altitude Algo permits a deposit or payment plan:
Any specific deposit, instalment or payment arrangement communicated in writing to the customer forms part of these Terms.
Nothing in this section limits any rights available to a consumer under the Australian Consumer Law.
Certain Altitude Algo software products may also be available under a separate monthly or annual subscription.
Where a recurring subscription is purchased, the subscription terms, billing frequency and price shown at checkout apply to that subscription.
A standalone software subscription is separate from the $8,000 Altitude Algo educational program unless the relevant offer expressly states otherwise.
Recurring charges will continue until cancelled in accordance with the terms disclosed when the subscription was purchased.
Program access is personal to the purchaser.
Customers must not:
Altitude Algo may suspend or terminate access where there is a serious or repeated breach of these conditions.
Dates, times, presenters and delivery methods for live education may occasionally change because of operational circumstances or presenter availability.
Where reasonably possible, Altitude Algo will provide advance notice of material changes.
Altitude Algo may substitute a presenter, reschedule a session or provide an equivalent session or recording where appropriate.
Nothing in this provision limits a customer's rights under the Australian Consumer Law where a material change constitutes a failure to provide the service purchased.
Altitude Algo does not provide refunds merely because a customer:
However, nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
Where the Australian Consumer Law entitles a customer to a remedy because of a failure in the goods or services supplied, Altitude Algo will provide the remedy required by law.
Customers may receive immediate access to valuable digital content, software, intellectual property, course materials or member resources following purchase or activation.
Access to these materials does not remove or limit any statutory consumer rights.
Where a package includes access or a pathway to a funded trading account, funded trader program, trading challenge or proprietary trading opportunity, additional terms and eligibility requirements may apply.
Unless expressly stated otherwise:
Altitude Algo does not guarantee that any customer will receive, retain or profit from a funded trading account.
Certain Altitude Algo tools operate through TradingView.
TradingView® is a registered trademark of TradingView, Inc.
Altitude Algo is not TradingView, and TradingView does not own, sponsor, approve or endorse Altitude Algo unless expressly stated otherwise.
Customers may require a compatible TradingView account to use certain functionality.
Availability of third-party platforms is outside Altitude Algo's control.
Our services may integrate with or rely on third parties including payment processors, software providers, communications platforms, analytics services, hosting providers, funded trading providers and TradingView.
Third-party services are governed by their own terms and privacy policies.
Altitude Algo is not responsible for outages or failures caused solely by third-party platforms outside our reasonable control.
All Altitude Algo software, indicators, branding, videos, training, course materials, presentations, strategies, documents, graphics, designs and other proprietary materials are owned by or licensed to Altitude Algo.
Purchasing a program gives the customer a limited, personal, non-exclusive and non-transferable right to use the materials for their own educational purposes.
Ownership of the intellectual property does not transfer to the customer.
Testimonials and customer experiences displayed by Altitude Algo represent individual experiences.

Results in financial markets vary significantly between individuals.
Customers are responsible for:
To the maximum extent permitted by law, Altitude Algo is not responsible for trading losses, investment losses or financial decisions made by a customer based on educational content or use of our software.
Nothing in these Terms excludes liability or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
Customers should contact Altitude Algo first if they believe a payment has been incorrectly processed or there is a problem with the service supplied.
Nothing in this clause prevents a customer from exercising a lawful right to dispute a transaction with their payment provider or exercising any right available under applicable consumer law.
Altitude Algo may suspend or terminate access where a customer:
Termination does not remove any statutory rights a customer may have.
Personal information is handled in accordance with the Altitude Algo Privacy Policy, which forms part of these Terms.
Altitude Algo may update these Terms from time to time.
Any revised terms will apply prospectively.
Where a material change affects a customer who has already purchased an ongoing service, Altitude Algo will take reasonable steps to notify affected customers and will comply with applicable consumer law.
These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws of Australia.
